Family faces alleged killer as preliminary hearing opens in Orem

Charlie Kirk was fatally shot on 10 September 2025 while speaking at Utah Valley University in Orem, prosecutors said on Monday, and authorities have arrested 23-year-old Tyler Robinson on charges including aggravated murder and felony discharge of a firearm; Utah County prosecutors are seeking the death penalty.

Robinson, who was arrested two days after the shooting, has been charged with aggravated murder, felony discharge of a firearm, obstructing justice and witness tampering, court records show. He has not entered a plea.

On Monday the Kirk family — including his widow Erika, his parents Robert and Kathryn, and his sister Mary — attended the preliminary hearing, issuing a joint statement saying Charlie was a beloved husband, son, brother, friend and father and asking for privacy as they navigate their grief.

Defense attorneys previously sought to suppress evidence and asked Judge Tony Graf to remove the death penalty from consideration; they also unsuccessfully attempted to ban cameras from the courtroom. Robinson appeared at the defense table wearing a light-coloured suit and sat between his attorneys.

Prosecutors told the court they expected four law enforcement witnesses to testify on Monday. The preliminary hearing proceedings are scheduled to continue through Friday as the prosecution lays out its evidence.

The family statement released before the hearing thanked supporters for their prayers and kindness and said the outpouring had sustained them during this period, adding that out of respect for the judicial process they would not comment further.

Court officials and prosecutors are proceeding with the preliminary hearing to determine whether there is sufficient evidence to bind Robinson over for trial, while Utah County prosecutors pursue capital charges in the case.
